In its planned application next week it would have sought summary judgement orders against him for the money. It will now seek the 8.3m euro in a full plenary hearing later this year. Mr Drumm, who is now living in the US, has claimed in letters to the bank that he has sufficient assets to meet his liabilities to it. However, he argues that its demand for immediate repayment is premature and in breach of loan agreements with him. Anglo Irish Bank replies that Mr Drumm has failed to date to file a statement of affairs. Anglo has brought two actions, one against Mr Drumm over non-repayment of loans, and another against him and his wife to set aside the transfer of their Malahide home into his wife's name. Mr Drumm has also counterclaimed for 2.6m euro arising from the termination of his employment and his loss of bonuses. Most of the 8.3m euro being sought in the main case relates to the refinancing of a facility to enable Mr Drumm to invest in Anglo shares. |
